The North Carolina Railroad Co. (NCRR) announced that it has initiated litigation against Norfolk Southern in Superior Court and before the US STB asserting rental, property ownership, environmental, and other claims arising out of the expiration of its leases with Norfolk Southern. The 317 mile NCRR line had been built in 1856 and largely owned by the state, but leased to the Southern Railway for a 99 year period in 1896. The Southern main line between Atlanta and Washington includes a substantial portion of the NCRR. NS was unhappy about the collapse of the re-lease negotiations and stopped the lease payments, even while continuing to use the tracks. Ultimately, NS agreed to pay a substantial increase in annual payments, and NCRR and NS reached an exclusive Trackage Rights agreement for NS’s continuing operation on the NCRR line for 15 years, renewable for an additional 30 years.
